Abstrak
Islam mensyariatkan pemeliharaan kesehatan, baik dengan cara kuratif melalui
pengobatan saat sakit ataupun preventif melalui vaksin; akan tetapi saat ini seiring dengan
perkembangan ilmu pengetahuan banyak obat dan vaksin yang beredar di pasaran berasal
dari bahan yang beraneka ragam dan belum diketahui kehalalannya. Saat ini sel tubuh
manusia khususnya human diploid cell banyak digunakan sebagai bahan baku, bahan
tambahan, dan/atau bahan penolong produksi obat dan vaksin yang karenanya
menimbulkan pertanyaan dari masyarakat tentang hukum penggunaannya. Sehingga perlu
dicari kebenaran hukum mengenai Penggunaan Human Diploid Cell untuk Bahan Produksi
Obat dan Vaksin, sebagai pedoman. Tulisan ini menggunakan metode kualitatif analisis
deskriptif dengan menggunakan pendekatan atau kajian kepustakaan (Studi literatur).
Pendekatan ini berusaha menjelaskan secara lengkap mengenai hukum penggunaan
Human Diploid Cell sebagai bahan produksi obat dan vaksin. Karena sedang mengalami
kondisi kedaruratan (dharurah syar’iyah) atau kebutuhan mendesak (hajah syar’iyah),
sehingga penggunaan human diploid cell untuk bahan obat atau vaksin hukumnya boleh.

A. Pendahuluan
Syariat Islam bertujuan memelihara keselamatan agama, jiwa, akal,
keturunan, dan harta, dan karena itu, segala sesuatu yang memberi manfaat
bagi tercapainya tujuan tersebut diperintahkan, dianjurkan atau dibolehkan
untuk dilakukan, sedang yang menghambat terwujudnya tujuan di atas
dilarang. Untuk mencapai tujuan tersebut, Islam mensyariatkan pemeliharaan
kesehatan, baik dengan cara kuratif melalui pengobatan saat sakit ataupun
preventif melalui vaksin; akan tetapi saat ini seiring dengan perkembangan ilmu
pengetahuan banyak obat dan vaksin yang beredar di pasaran berasal dari
bahan yang beraneka ragam dan belum diketahui kehalalannya.
Saat ini sel tubuh manusia khususnya human diploid cell banyak digunakan
sebagai bahan baku, bahan tambahan, dan/atau bahan penolong produksi obat
dan vaksin yang karenanya menimbulkan pertanyaan dari masyarakat tentang
hukum penggunaannya. Sehingga Komisi Fatwa MUI memandang perlu
menetapkan fatwa tentang Penggunaan Human Diploid Cell untuk Bahan
Produksi Obat dan Vaksin, sebagai pedoman.
B. Kajian Teori
Human diploid sel adalah salah satu sel yang digunakan untuk mengkultur
virus yang akan dijadikan vaksin. HDC yang berasal dari aborsi manusia ini
banyak digunakan untuk mengkultur virus Polio IPV dan OPV, Rabies, Rubella,
Measles,Varicella-Zooster, Covid-19 dan Hepatitis A. Beberapa alasan HDC
digunakan karena jumlah sel yang banyak dalam satu kali panen, karakteristik
yang baik, kesuksesan terhadap virus manusia, kemungkinan laten yang
rendah, dan pengadaan yang relatif murah. (Syauqibik, 2022)
Vaksin Polio merupakan salah satu vaksin yang menggunakan HDC yang
dikultur dari sel janin abortus, hal ini bertentangan dengan beberapa agama
seperti Islam, Hindu, Protestan, dan Saksi Jehovah. Ini juga bermasalah dengan

kode etik kedokteran, yaitu autonomi dan non-maleficence. Dengan autonomi
dari orang tua anak mengatakan “anak kami, pilihan kami” dan non-
maleficence dari tenaga kerja yang berkewajiban untuk mencegah kerugian bagi
masyarakat luas. (Hussain et al., 2018)
Definisi obat menurut Peraturan Menteri Kesehatan Republik Indonesia
Nomor 58 tahun 2014 yaitu obat termasuk produk biologi yang digunakan
untuk mempengaruhi atau menyelidiki sistem fisiologi atau keadaan patologi
dalam rangka penetapan diagnosis, pencegahan, penyembuhan, pemulihan,
peningkatan kesehatan dan kontrasepsi untuk manusia.
Vaksin adalah produk biologis yang dapat memicu tubuh menghasilkan
imunitas spesifik terhadap suatu penyakit. Vaksin mengandung antigen,
partikel yang merangsang sistem imun, yang dapat berupa virus hidup yang
sudah dilemahkan, virus yang sudah mati, bagian permukaan virus, atau toksin
bakteri23 . Untuk memproduksi vaksin yang ditargetkan pada penyakit yang
disebabkan oleh virus, terlebih dahulu virus diperbanyak di dalam sel hewan
dalam skala pabrik, karena virus tidak dapat “hidup” di luar sel. Telur (sel
hewan) banyak digunakan untuk menanam virus, yang kemudian hasil
panennya adalah antigen. (Sari & Sriwidodo, 2020)
C. Metode Penelitian
Dalam penelitian ini peneliti menggunakan metode penelitian kualitatif
analisis deskriptif dengan menggunakan pendekatan atau kajian kepustakaan
(Studi literatur). Pendekatan ini berusaha menjelaskan secara lengkap mengenai
hukum penggunaan Human Diploid Cell sebagai bahan produksi obat dan
vaksin, dengan berusaha mencari dokumen, jurnal ilmiah dan buku yang
kemudian dianalisis dan dijelaskan secara lengkap.
Studi Literatur merupakan Metode dengan kajian kepustakaan (Studi
literatur) merupakan sebuah metode untuk menyelesaikan persoalan dengan
menelusuri sumber-sumber tulisan yang pernah dibuat sebelumnya. Sumber
sumber yang didapat dijadikan sebagai bahan Studi literatur dan disusun
menurut kaidah penulisan ilmiah. Adapun hal-hal yang dapat dilakukan dalam
Studi literatur ini seperti mengupas (Cnticze), membandingkan (Compare),
meringkas (Summarize), dan mengumpulkan (SynthesizeI).

Hai sekalian manusia, makanlah yang halal lagi baik dari apa yang
terdapat di bumi, dan janganlah kamu mengikuti langkah-langkah syaitan;
karena sesungguhnya syaitan itu adalah musuh yang nyata bagimu. (QS.
Al-Baqarah [2]: 168)
g. Ayat yang menjelaskan bahwa segala sesuatu yang halal pasti baik dan
yang haram pasti buruk:

h. Ayat yang menjelaskan bahwa dalam kondisi kedaruratan dibolehkan
mengkonsumsi yang haram, antara lain:

Merusak tulang seseorang yang telah meninggal seperti merusak tulang
seseorang yang masih hidup.” (HR. Ahmad, Abud Dawud,dan Ibn Majah).
Dari Ashim bin Umar bin Qatadah sesungguhnya Qatadah bin an-Nu’man
jatuh matanya di pipinya ketika perang Uhud, kemudian Rasulullah Shalla
Allahu Alaihi Wa Sallam mengembalikannya kemudian menjadi mata yang
paling bagus. (HR. Ibn Abi Syaibah)

Membunuh manusia atau memotong memisahkan organ tubuhnya tidak
diperbolehkan kecuali ada kemaslahatan.
Manusia tidak bisa menggugurkan haknya dalam sesuatu yang dimiliki Allah.
Hak Allah itu itu bersifat lentur berbeda dengan hak manusia kecuali dalam
keadaan darurat.

Jika seorang perempuan hamil meninggal dan di perutnya ada janin
hidup, maka perut mayat perempuan tersebut harus dibedah karena untuk
menyelamatkan janin tersebut agar tetap hidup dengan merusak bagian
dari mayat. Kasus ini (hukumnya) sama dengan jika keadaan dharurah
memakan bagian dari bangkai.
(anggota tubuh yang terlepas dari tubuh yang hidup adalah seperti
bangkai/mayatnya) baik kesucian atau kenajisannya. Tangan manusia
(yang lepas) hukumnya suci, berbeda dengan pendapat kebanyakan. Dan
paha kambing (yang lepas) hukumnya najis, sebagaimana hadis hasan-
shahih {setiap bagian hewan yang lepas ketika masih hidup maka (yang
lepas tadi) hukumnya seperti bangkai (najis)}
Human Diploid Cell (sel diploid manusia) adalah sel yang memiliki jumlah
kromosom ganda yaitu memiliki dua set kromosom yang berjumlah 46. Sel
tubuh manusia adalah satuan terkecil yang membentuk jaringan serta organ
manusia. Pada dasarnya penggunaan sel yang berasal dari bagian tubuh
manusia untuk bahan obat atau vaksin hukumnya haram, karena bagian tubuh
manusia (juz’u al-insan) wajib dimuliakan.
Dalam hal terjadi kondisi kedaruratan (dharurah syar’iyah) atau kebutuhan
mendesak (hajah syar’iyah), penggunaan human diploid cell untuk bahan obat
atau vaksin hukumnya boleh, dengan syarat:
a. Tidak ada bahan lain yang halal dan memiliki khasiat atau fungsi serupa
dengan bahan yang berasal dari sel tubuh manusia;
b. Obat atau vaksin tersebut hanya diperuntukkan bagi pengobatan penyakit
berat, yang jika tanpa obat atau vaksin tersebut maka berdasarkan
keterangan ahli yang kompeten dan terpercaya diyakini akan timbul dampak
kemudaratan lebih besar;
c. Tidak ada bahaya (dharar) yang mempengaruhi kehidupan atau
kelangsungan hidup orang yang diambil sel tubuhnya untuk bahan
pembuatan obat atau vaksin;
d. Apabila sel tubuh manusia yang dijadikan bahan obat atau vaksin bersumber
dari embrio, maka harus didapatkan melalui cara yang dibolehkan oleh
syariat, seperti berasal dari janin yang keguguran spontan atau digugurkan
atas indikasi medis, atau didapatkan dari sisa embrio yang tidak dipakai
pada inseminasi buatan atau IVF (in vitro fertilization);
e. Pengambilan sel tubuh manusia harus mendapatkan izin dari pendonor;
f. Dalam hal sel tubuh berasal dari orang yang sudah meninggal harus
mendapatkan izin dari keluarganya;
g. Sel tubuh manusia yang menjadi bahan pembuatan obat atau vaksin
diperoleh dengan niat tolong-menolong (ta’awun), tidak dengan cara
komersial.
h. Kebolehan pemaanfaatannya sebatas untuk mengatasi kondisi kedaruratan
(dharurah syar’iyah) atau kebutuhan mendesak (hajah syar’iyah).

E. Kesimpulan
Human Diploid Cell (sel diploid manusia) adalah sel yang memiliki jumlah
kromosom ganda yaitu memiliki dua set kromosom yang berjumlah 46. Sel
tubuh manusia adalah satuan terkecil yang membentuk jaringan serta organ
manusia. Pada dasarnya penggunaan sel yang berasal dari bagian tubuh
manusia untuk bahan obat atau vaksin hukumnya haram, karena bagian tubuh
manusia (juz’u al-insan) wajib dimuliakan.
Dalam hal terjadi kondisi kedaruratan (dharurah syar’iyah) atau kebutuhan
mendesak (hajah syar’iyah), penggunaan human diploid cell untuk bahan obat
atau vaksin hukumnya boleh, dengan syarat yakni tidak ada bahan lain yang
halal dan memiliki khasiat atau fungsi serupa dengan bahan yang berasal dari
sel tubuh manusia, sebagai obat untuk penyakit yang berat, tidak terdapat
bahaya di dalamnya (dharar), serta untuk mengatasi kondisi kedaruratan
(dharurah syar’iyah) atau kebutuhan mendesak (hajah syar’iyah).

Abstract
Islam requires health maintenance, either curatively through treatment when sick or
preventatively through vaccines; However, currently, along with the development of science,
many medicines and vaccines on the market come from various ingredients and their halal
qualities are not yet known. Currently, human body cells, especially human diploid cells,
are widely used as raw materials, additional materials, and/or auxiliary materials for the
production of medicines and vaccines, which therefore raises questions from the public
regarding the law of their use. So it is necessary to seek legal truth regarding the use of
human diploid cells for drug and vaccine production, as a guide. This paper uses a
qualitative method of descriptive analysis using an approach or literature study (literature
study). This approach attempts to explain in full the law regarding the use of Human
Diploid Cells as a material for producing medicines and vaccines. Because we are
experiencing an emergency (dharurah syar'iyah) or urgent need (hajah syar'iyah), the use of
human diploid cells as a medicine or vaccine is legally permissible.

A. Introduction
Islamic Sharia aims to maintain the safety of religion, soul, mind, offspring
and property, and therefore, everything that benefits the achievement of this goal
is ordered, recommended or permitted to be done, while anything that hinders
the realization of the above goal is prohibited. To achieve this goal, Islam
requires health care, either curatively through treatment when sick or
preventatively through vaccines; However, currently, along with the development
of science, many medicines and vaccines on the market come from various
ingredients and their halal qualities are not yet known.
Currently, human body cells, especially human diploid cells, are widely used
as raw materials, additional materials, and/or auxiliary materials for the
production of medicines and vaccines, which therefore raises questions from the
public regarding the law of their use. So the MUI Fatwa Commission considers it
necessary to issue a fatwa regarding the Use of Human Diploid Cells for Drug
and Vaccine Production Materials, as a guideline.
B. Theoritical review
Human diploid cells are one of the cells used to culture viruses that will be
used as vaccines. HDC which comes from human abortion is widely used to
culture Polio IPV and OPV viruses, Rabies, Rubella, Measles, Varicella-Zooster,
Covid-19 and Hepatitis A. Some of the reasons why HDC is used is because of
the large number of cells in one harvest, a characteristic that good, success
against human viruses, low latency probability, and relatively cheap
procurement.(Syauqibik, 2022)
The Polio vaccine is a vaccine that uses HDC cultured from aborted fetal
cells, this is contrary to several religions such as Islam, Hinduism, Protestantism
and Jehovah's Witnesses. This also has problems with the medical code of
ethics, namely autonomy and non-maleficence. With the autonomy of the child's

parents saying “our child, our choice” and the non-maleficence of a workforce
that is obliged to prevent harm to society at large.(Hussain et al., 2018)
The definition of drugs according to the Regulation of the Minister of Health
of the Republic of Indonesia Number 58 of 2014 is that drugs include biological
products that are used to influence or investigate physiological systems or
pathological conditions in the context of determining diagnosis, prevention,
healing, recovery, improving health and contraception for humans.
Vaccines are biological products that can trigger the body to produce specific
immunity against a disease. Vaccines contain antigens, particles that stimulate
the immune system, which can be live weakened viruses, dead viruses, surface
parts of viruses, or bacterial toxins23. To produce vaccines targeted at diseases
caused by viruses, the viruses are first reproduced in animal cells on a factory
scale, because viruses cannot "live" outside cells. Eggs (animal cells) are widely
used to grow viruses, the harvest of which is antigen.(Sari & Sriwidodo, 2020)
C. Research methods
In this research the researcher used a qualitative research method of
descriptive analysis using an approach or literature review (literature study).
This approach attempts to explain in full the law regarding the use of Human
Diploid Cells as a material for producing medicines and vaccines, by trying to
find documents, scientific journals and books which are then analyzed and
explained in full.
Literature study is a method where literature study (literature study) is a
method for solving problems by tracing written sources that have been written
before. The sources obtained are used as material for literature studies and are
arranged according to the rules of scientific writing. There are things that can be
done in this literature study, such as analyzing (Cnticze), comparing (Compare),
summarizing (Summarize), and collecting (SynthesizeI).
b. The verse which explains that human body parts actually belong to Allah
subhanahu wa ta'ala:
And when I am sick, He is the One who heals me. (QS. Al-Syu'ara [26]: 80)
d. Verses that explain the prohibition against falling into perdition include:

…and do not throw yourself into destruction…(QS. al-Baqarah [2]: 195)
O people, eat what is lawful and good from what is on earth, and do not
follow the steps of the devil; because actually the devil is a real enemy for
you.(QS. Al-Baqarah [2]: 168)
And help you in (doing) righteousness and piety, and do not help you in
committing sins and transgressions.(QS. al-Mâidah [5]:2)
And they put (the Muhajirin) before themselves, even though they were in
trouble. And whoever keeps himself from stinginess, those are the lucky
ones.(QS. Al-Hasyr [49]: 9)
And among humans there are those who sacrifice themselves seeking
Allah's pleasure; and Allah is Most Merciful to His servants. Surah Al-
Baqarah.(QS. Al-Baqarah [2]:207)
g. The verse explains that everything that is halal must be good and what is
haram must be bad:
And Allah has made lawful for them everything that is good, and forbid
them everything that is bad.(QS. al-A'raf [7]: 157)
Indeed, Allah has only forbidden you carrion, blood, pork and animals
which (when slaughtered) are called (names) other than Allah. But whoever
is forced to (eat it) and does not want it and does not (also) exceed the limit,
then there is no sin for him. Indeed, Allah is Forgiving, Most Merciful. (QS.
Al-Baqarah [2]: 173)

And indeed Allah has explained to you what He has forbidden you, except
what you are forced to eat(QS. Al-An'am [6]: 199)
From Abu Hurairah RA, from the Prophet sallallaahu 'Alaihi wa Sallam:
Indeed, Allah does not send down a disease except (also) the medicine for
it.(HR. al-Bukhari)
From Usamah bin Syarik, in fact the Messenger of Allah Shalla Allahu
Alaihi Wa Sallam. said: Get treatment, because Allah does not create
disease except He also creates a cure for it, except for one disease, namely
old age.(HR. Abu Dawud, Tirmidhi, Nasa'i and Ibn Majah)
Breaking the bones of someone who has died is like breaking the bones of
someone who is still alive.”(HR. Ahmad, Abud Dawud, and Ibn Majah).
From Muhammad bin Ishaq, in fact the Messenger of Allah Shalla Allahu
Alaihi Wa Sallam. returned Khabib bin Yusaf's hand which was broken on
the day of the Battle of Badr, then Rasulullah Shalla Allahu Alaihi Wa

Sallam. restore it so that it is not visible (scar) except like a line.(HR. Ibn Abi
Syaibah)
From Ashim bin Umar bin Qatadah, in fact, Qatadah bin an-Nu'man had
his eyes fall on his cheeks during the battle of Uhud, then Rasulullah Salla
Allahu Alaihi Wa Sallam restored them and became the best eyes.(HR. Ibn
Abi Syaibah)
When there are two evils, avoid the one with the greater evil by doing the one
with the lesser evil.
You must not interfere with other people's rights without their permission.
Killing humans or cutting apart their body organs is not permitted unless there
is a benefit.
Allah's rights are flexible, different from human rights, except in emergency
situations.

Respecting living people and preserving their lives takes priority over respecting
dead people to have their organs removed.
If a pregnant woman dies and there is a living fetus in her stomach, then
the woman's stomach must be opened because to save the fetus, it remains
alive by destroying part of the corpse. This case (the law) is the same as if
it were a state of dharurah to eat part of a carcass.

contrary to most opinions. And the leg of a goat (which falls off) is unclean,
according to the Hasan-Sahih hadith {every part of the animal that comes
off while it is still alive is considered to be like a carcass (unclean)}
Human Diploid Cells(human diploid cells) are cells that have a double
number of chromosomes, that is, they have two sets of chromosomes totaling 46.
Human body cells are the smallest units that form human tissues and organs.
Basically, the use of cells originating from parts of the human body for
medicines or vaccines is haram, because parts of the human body (juz'u al-
insan) must be respected.
In the event of an emergency (dharurah syar'iyah) or urgent need (hajah
syar'iyah), the use of human diploid cells for medicinal or vaccine ingredients is
legally permissible, provided that:
a. There are no other ingredients that are halal and have similar properties or
functions to ingredients derived from human body cells;
b. The drug or vaccine is only intended for the treatment of serious illnesses,
without which the drug or vaccine, based on information from competent and
trusted experts, is believed to result in greater harm;
c. There is no danger (dharar) that affects the life or survival of the person whose
body cells are taken as ingredients for making medicines or vaccines;
d. If human body cells used as ingredients for medicines or vaccines come from
embryos, they must be obtained through methods permitted by the Shari'a,
such as from fetuses that have spontaneously miscarried or been aborted for
medical indications, or obtained from remaining embryos that are not used in
artificial insemination or IVF. (in vitro fertilization);
e. Taking human body cells must obtain permission from the donor;
f. In the event that body cells come from a deceased person, permission must be
obtained from the family;
g. Human body cells that are used as ingredients for making medicines or
vaccines are obtained with the intention of helping each other (ta'awun), not
by commercial means.
h. The ability to use it is limited to dealing with emergency conditions (dharurah
syar'iyah) or urgent needs (hajah syar'iyah).
E. Conclusion
Human Diploid Cells(human diploid cells) are cells that have a double
number of chromosomes, that is, they have two sets of chromosomes totaling 46.
Human body cells are the smallest units that form human tissues and organs.
Basically, the use of cells originating from parts of the human body for
medicines or vaccines is haram, because parts of the human body (juz'u al-
insan) must be respected.
In the event of an emergency (dharurah syar'iyah) or urgent need (hajah
syar'iyah), the use of human diploid cells for medicinal or vaccine ingredients is
legally permissible, provided that there are no other ingredients that are halal
and have similar properties or functions to the ingredients. which comes from
human body cells, as a medicine for serious diseases, there is no danger in it
(dharar), as well as to overcome emergency conditions (dharurah syar'iyah) or
urgent needs (hajah syar'iyah).
