 Rules and regulation
1. The aviation act No. 1 Year 2009
• Established the authorization and responsibilities
of all aspect of aviation in Indonesia

2. Civil Aviation Safety Regulations (CASR)

• Issued by Ministry decree as the DGCA principal
method of setting for the aviation safety
requirement for Republic of Indonesia.
• The CASRs are minimum safety standards or
minimum safety regulations

Pasal 4
a. Semua kegiatan penggunaan wilayah udara, navigasi
penerbangan, pesawat udara, bandar udara, pangkalan
udara, angkutan udara, keselamatan dan keamanan
penerbangan serta fasilitas penunjang dan fasilitas
umum lain yang terkait, termasuk kelestarian lingkungan
di wilayah NKRI
b. Semua pesawat udara asing yang melakukan kegiatan
dari dan/atau ke wilayah NKRI
c. Semua pesawat udara Indonesia yang berada di luar
wilayah NKRI

 SANKSI DALAM PENERBANGAN SIPIL
1. SANKSI PIDANA:
- Bab XXII (Ketentuan Pidana), Pasal 401 s/d 443
- Hukuman: Penjara paling lama lima belas tahun dan
Denda paling banyak Rp. 15.000.000.000,- (lima
belas miliar rupiah)
- Kejahatan oleh korporasi denda bisa 3x lipat

2. SANKSI ADMINISTRTIF/ADMINISTRASI:
- Beberapa Pasal dalam UU Penerbangan No. 1/2009
- PP No. 3 tahun 2003 pasal 99 s/d 102
- KM No. 26 tahun 2009
- Hukuman: Peringatan ke-1 s/d ke-3 (tenggat waktu
sebulan), pembekuan sertifikat/izin maksimal 3 bulan, dan
pencabutan sertifikat/izin
 Interpretations of Regulation
• It is the DGCA duty and responsibility to ensure safety in all civil
aviation matters. This carried out by prescribing and revising from
certain minimum safety standards are generally issued in the form of
civil aviation safety regulation (CASR)

• CASR are prescribing as minimum standards, are often written in a

broad and general sense to give the aviation community latitude to
develop higher safety standards in their own product and or
operation.

• The DGCA retains full right, authority and legal obligation to

interprete the case.
 Staff Instruction and Advisory Circular

• Staff instructions
– Are issued for the principal purpose of providing
guidance to DGCA STAFF in carring out their day to
day activities regarding regulatory function.

• Advisory circulars
– Are issued for principal use aviation community to
provide industry with “an acceptable mean of
compliance” to appliance regulations.
