Ø Negotiation
1. Putri bought BTS ticket concert for IDR 1.000.000 (one million rupiah) on Go
Ticket platform;
2. Putri ordered Bajaj to take her to PRJ where BTS concert has taken place;
3. Whilst waiting BTS perform, Putri ordered Mcdonalds lunch set for her meal;
4. Putri met her senior high school ex boyfriend there, Putra, (with no one – in
case you are getting curious) and they talked lot about BTS;
5. Putra asked Putri for have having coffee in the starbucks next to Mcdonalds.
Putra had a Venti (extra large) Asian Dolce Latte for Putri who was sitting back
outside.;
6. Putra asked Putri whether she already had a ticket and Putri said no. Putra
then found a broker a bought a ticket for IDR 3.000.000 (three million rupiah)
for Putri.
7. Putri was surprised then she called the broker and sold her ticket for IDR
1.500.00o. Putra extremely shocked to see that.

Forms of contract
• In general, an agreement does not have to be in writing, a verbal
consent is sufficient; unless regulated otherwise
• Ps. 31 UU 24/2009:
1. Bahasa Indonesia wajib digunakan dalam nota
kesepahaman atau perjanjian yang melibatkan lembaga
negara, instansi pemerintah Republik Indonesia, lembaga
swasta Indonesia atau perseorangan warga negara Indonesia.
2. Nota kesepahaman atau perjanjian sebagaimana dimaksud
pada ayat (1) yang melibatkan pihak asing ditulis juga
dalam bahasa nasional pihak asing tersebut dan/atau bahasa
Inggris.

The Case Of A Minor Social Media Endorser
● Cinta is a Youtube vlogger who regularly reviews children toys at Youtube. At the age of 20, Cinta has
already gained a massive 8 million followers. She regularly signs long-term endorsement contract for toys
with manufacturers or retailers. She imposes a standard fee of Rp. 12 million per posting, for a 3-year
contract. One of the endorsement contracts was signed with Lego, a toy producer, on the 11th of February
2019, when she was still 20.
(a) Let’s say on the 11th of February 2019 when she signed the contract, Cinta claimed and declared to Lego
that she was indeed an adult at the age of 25. Lego never checked her ID card.
(b) On the 1st of April 2019, she contacted Lego to renegotiate the contract and demand a higher fee of
Rp20 million per posting. Otherwise, she will annul the contract.
(c) Lego decided not to renegotiate the contract. Therefore, Cinta wanted to get out of her contract. She
would like to get out of the contract by admitting to Lego that she had lied about her age (lacked
capacity when she signed the deal at 20).

gugatan, ganti kerugian, dan/atau sanksi yang timbul atau akan timbul dari pihak manapun, termasuk tetapi tidak
terbatas pada instansi pemerintah atas tidak terpenuhinya ketentuan ayat ini.

awalnya telah di jadwalkan untuk Penyelesaian dan Klausul 9.3 akan berlaku pada saat penyelesaian.
